Este cargo no puede sostenerse por sí solo

La ley de Washington exige que el Estado demuestre dos cosas para que este cargo se sostenga: que realmente ocurrió un delito subyacente de violencia doméstica y que la persona impidió o intentó impedir que la víctima o un testigo llamara al 911, buscara ayuda médica o informara a la policía. Ese segundo requisito —que haya ocurrido un delito de violencia doméstica— no es opcional.

Este cargo casi siempre se presenta junto con otro, como Assault (agresión), Harassment (acoso) o Malicious Mischief (daños maliciosos a la propiedad), y en la práctica una defensa sólida contra el cargo subyacente suele ser también una defensa sólida contra este.

¿Ocurrió realmente un delito de violencia doméstica?

En ocasiones, las personas llaman al 911 para informar hechos que no ocurrieron como los describen, especialmente en medio de una discusión en la que las emociones están exaltadas. Si alguien quitó un teléfono para impedir una denuncia falsa o actuó en defensa propia durante el incidente subyacente, el Estado debe demostrar que el delito subyacente realmente ocurrió como se alega y que la defensa propia no se aplica; de lo contrario, este cargo tampoco puede prosperar.

¿Estaba claro que la persona intentaba llamar al 911?

Quitar un teléfono durante una discusión no constituye automáticamente un delito. Las personas usan el teléfono durante una discusión por todo tipo de motivos: para pedir transporte, llamar a un familiar o grabar a la otra persona, algo que a su vez está restringido por las leyes de Washington sobre consentimiento para grabaciones.

A menudo es un hecho verdaderamente controvertido, y no algo obvio, si estaba claro que la persona intentaba comunicarse específicamente con el 911 u obtener otro tipo de ayuda.

I met Roger at the start of 2025, somehow after I paid for a fender bender that I caused I was hit with a hit and run little did I know when I had a warrant two years after the incident.
